Your relationship with us is treated with great confidentiality. We view the security and confidentiality of Customer Information as a top priority throughout Southern Community Bank and Trust. We do not sell or share Customer Information with outside companies for purposes of independent telemarketing or selling of any non-financial products or services to you.

We are committed to bringing you the services you need to succeed financially. If we do not offer a financial service, such as some insurance or loan products or credit card services, we may establish a joint marketing program with an outside company, a "Marketing Associate," to offer that service to you. These programs include confidentiality agreements to protect consumer information and prohibit the outside company from using customer information for any reason other than that for which they have been contracted, or as permitted by law.

Security Procedures Protect Your Information

Customer information will only be disclosed to authorized account holders, and only after identification of that account holder has been verified. If the information request is made over the telephone and we are uncertain about the identity of the person requesting the information, we will ask that the request be made in writing or in person, or require that we call back to give the information. The call must be to a telephone number we currently have on file to contact you. Another alternative is to require the customer to obtain information by way of our 24-hour Telephone Banking System or Online Banking which maintains personal PIN knowledge.

Procedures have been implemented to assure that only authorized Bank employees may view the information shared with us. This is accomplished by limiting access to information (via access capability and password control) to only those employees having a legitimate business purpose for viewing or responding to information or inquiries.

Why We Collect, Retain, and Use Customer Information

Southern Community Bank and Trust will share personal or financial customer information for both current and former customers with unaffiliated third parties when legally required or when legally permitted to serve the customer's interests and to provide operational support to the Bank. Information will be disclosed to unaffiliated third parties under the following conditions as allowed by law:

  • Where it is necessary to complete a transaction initiated by the customer. (Such as to a customer's attorney involving a loan closing).
  • In order to report the existence and condition of an account to companies such as reputable credit bureaus or merchants.
  • In order to comply with federal or state laws/regulations, and government or court orders.
  • If we have the written permission of the account holder.
  • In connection with a sale, merger, transfer or exchange of all or a portion of our business.
This information shared could include application information, such as assets, and income; identifying information such as name, address, and social security number; and transaction information, such as information about personal account balance, payment history, and credit card usage; and information from consumer reports such as a consumer's creditworthiness and credit history. Importantly, we use some of the data we collect to maintain the security of your account and to protect the privacy of your financial information. We are then able to positively identify you as our customer and prevent access to your account information by unauthorized individuals.

Southern Community Bank and Trust will not knowingly do business with any unaffiliated third party provider or company that uses or sells this information for marketing purposes.

An AFFILIATE is a company we own or control, a company that owns or controls us, and a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control. A NONAFFILIATED THIRD PARTY is a company that is not an affiliate of ours.

The Bank will share customer information with affiliated companies including consumer information included in Section 603(d)(2)(A)(iii) of the Fair Credit Reporting Act which includes information such as income and social security number unless you instruct us otherwise.

MARKETING

Direct marketing offers from Southern Community may include information about new products and services being offered by the bank. If you choose not to hear from us, you may not receive offers about Southern Community products and services that may be of value to you. Consumers may not prohibit the Bank from sharing nonpublic, personal information to a nonaffiliated third party who performs services or functions on behalf of the Bank.

If you elect not to receive direct marketing offers by mail, telephone or e-mail from Southern Community Bank and Trust you will continue to:
  • Be contacted as necessary to service your account
  • Receive marketing information included with your regular account mailings and statements, or when you visit us online or at an ATM.
From time to time, we carefully select business associates (other financial institutions and companies with whom we have joint marketing agreements) to provide our customers with specialized financial services, such as mortgage, insurance, investment or credit card services. Although these partners are not owned by, or affiliated with the Bank, they work closely with us to help us deliver products and services that meet your financial needs. If appropriate, we may disclose to these associates certain information, such as:
  • Information we received from you on applications or other forms, such as your name, address, or Social Security number;
  • Experience Information about your transactions with The Bank, such as your account balance or payment history
Our marketing associates must agree to safeguard the confidentiality of customer information, and they are not authorized to disclose this information to anyone else without our explicit permission, except as allowed by law.

See CHOICES for contact information to request that we do not share information with marketing associates. All of these companies work together to provide the accounts and services you want. With limited exceptions like those listed above, we do not provide client information to companies outside of Southern Community Bank and Trust. You do not need to request this confidentiality; it is our standard practice.

MAINTENANCE OF ACCURATE INFORMATION

The Bank has procedures in place to help assure that customers' information is accurate, current and complete. The Bank will update information, remove old information and correct known inaccurate information in a timely manner. Customers should notify the Bank immediately if they receive information regarding their relationship that they believe to be inaccurate.

INTERNET INFORMATION

Southern Community Bank and Trust recognizes the trust customers have placed in us and our responsibility regarding their financial privacy. It is our responsibility to keep sensitive financial and personal information confidential. We've always been committed to the protection of our customers' privacy.
  1. Web Site Security
    Southern Community Bank and Trust has implemented technology to assure that any sensitive personal information provided or any account information received on-line is done in a safe and secure manner. Special secure-connection hardware and software (commonly called "firewalls") are in place to assure the security of online communication of information. Whenever we ask for personal information on our web site, we use Secure Socket Layer (SSL) technology for transferring data. This technology encrypts - or scrambles - your account information. Please note that since we cannot control information on other Internet sites, we are not responsible for the content of sites linked from www.smallenoughtocare.com.
  2. Web Site Privacy
    Our Web Site includes sections that are public (not password protected) and areas that are password protected (for example, individual customer banking areas).
When any person visits the public areas of our Web Site, we may collect certain basic information, such as how many people visited our site and what pages were visited.

Unlike the personal information that a customer provides and views with respect to his personal banking relationship (which is subject to the security procedures described above), all of the information gathered in the public areas of the Web Site is general. We use this general information to determine which parts of the Web Site are most popular, how people access the site, how we can change the content of the Web pages to make them more helpful and how we can improve customer service.

Also included in Southern Community Bank and Trust's Web Site is the capability for a customer to correspond with the Bank. This correspondence, via e-mail, may be for the purpose of asking general questions, requesting literature, or responding to bank promotions. These activities may include sharing some personal information with Southern Community Bank and Trust. We preserve e-mail addresses, the content of your e-mail and any information provided (for example site registration or survey information) in order to more efficiently handle any follow-up questions you may have. We also do this to meet legal and regulatory requirements. E-mail is not a secure connection. In responding to customer inquiries we will not include confidential account information. For your protection, never send any nonpublic information such as your social security number or account number via e-mail. You may not receive notices of new products and services, or discounts for which you may be eligible.

Southern Community Bank and Trust will continue to share transaction information and other general information not used for determining eligibility for a product or service among the Southern Community Bank and Trust, as permitted by law.

Listed below are additional options customers may exercise to restrict the use of information by other companies not affiliated with our Bank. Please note that Southern Community Bank and Trust cannot make the choices for you or provide notification on your behalf.

Consumer Reporting Agencies

You may not prohibit Southern Community Bank and Trust from sharing your loan and deposit account history with consumer reporting agencies. However, you may request that consumer reporting agencies not provide information about you to companies wishing to extend "preapproved" offers to you for their products or services. You may make this request by calling the Opt-Out Request Line at 1-888-567-8688.

National Do Not Call Registry

Southern Community Bank and Trust supports the National Do Not Call Registry. To have your phone number added to the National Do Not Call Registry, you may call 1-888-382-1222 or register at www.fcc.gov/cgb/donotcall. While this will stop most marketing calls, you may still receive calls from businesses where you are a customer.

National Advertisers and Marketing Companies

You may request that the Direct Marketing Association delete your name from telephone and mail lists used by their members in marketing products and services to you. Information on these lists is normally obtained from public sources. Your request lasts for five years and should include all versions of your name in which you currently receive information, your address, and your telephone number, including the area code. Requests for deletion should be mailed to each of the following.

PROTECTING OUR CHILDREN

We do not knowingly collect or solicit data from children under 13, and we do not knowingly market to children. We recognize that protecting children's identities and privacy online is important and that the responsibility to do so rests with both the online industry and with parents.

If you decide to close your account(s) or become an inactive customer, we will follow the privacy policies and practices as described in this notice.

IDENTITY THEFT ASSISTANCE

If you believe you may have been a victim of identity theft:
  1. File a police report in your local jurisdiction and retain the report number and the name of the officer who took the report.
  2. Contact your local branch to place holds on your accounts.
  3. Contact the Social Security Administration's Fraud Hotline at 1-800-269-0271 to report fraudulent use of your identification information.
  4. Report the incident as quickly as possible to any one of the credit reporting agencies:

    You should review a current credit bureau report to identify any unauthorized accounts or inquiries and ask the credit reporting agency about placing a Victim Alert Flag on your files.
